Privacy:

Protection of personal privacy is a major concern of Basnight. Basnight maintains the anonymity of each responder unless that responder has expressed consent to release certain personal information or responses.

In the same way, Basnight protects the identity of those who access its Sites. The following policy provides details as to the types of information collected through Basnight web sites, including personal information and how it is treated. Information Collected by Web Site
Basnight Web sites gather information in two ways: (1) indirectly (for example, through site technology), and (2) directly (for example, when the site visitor voluntarily provides information on various pages).

1. Information Collected Indirectly
Basnight indirectly collects a variety of information pertaining to the use of its Sites. This information may include: your IP address, browser type, operating system, domain name, access times and referring web site addresses. This information is used for the general operation of the Sites, to maintain quality of the service, and to provide general statistics regarding use of our web sites.

Basnight also collects non-personal information about which pages our customers visit within our Sites. Our web servers do not record e-mail addresses or other personal information unless it is willingly provided by the individual when filling out a web form or registering on the Sites.

Only designated administrators have access to this information, and it is used only for administrative and planning purposes to meet the needs of our users, including but not limited to the improvement of the content of these Sites and the customization of the content and/or layout of these Sites for individuals or groups of users.
Other types of indirectly collected information are stored in “cookies.” Cookies are small files of electronic information that a web site can transfer to a visitor’s hard drive to help that visitor while on these Sites. Some Basnight Sites use cookies simply to store a user code so that users do not have to re-enter their information when rejoining these Sites. The use of cookies is standard on the Internet. Although most web browsers automatically accept cookies, the decision of whether to accept them is yours. A browser can usually be adjusted to prevent the reception of cookies, or to provide notification whenever a cookie is sent to you. Even without accepting a cookie, you can still access most of the features offered by Basnight Web sites.

Basnight will not share your information with other organizations besides its regional software distributors or subsidiaries without your prior approval with the exception of some instances below in Information Collected Directly.

2. Information Collected Directly
Basnight also collects information that is voluntarily provided by site when a site visitor registers or requests services through the Sites:

  • Contact Information & Professional Data: Such as name, phone number, email address, education, employment background, references, or other general information about you and your company. Basnight will never knowingly barter, trade, or sell access to our database of registered users. The personal information you provide to us when making a request may be made available to Basnight’s regional software distributors or a Basnight subsidiary for completing your request. After fulfilling your request, the information you provide may be used by us for direct marketing of Basnight, its subsidiaries, or regional software distributors, Basnight may use the services of a third parties to process your information and send you mailings.
  • Billing & Transaction Information: Such as credit card or other financial information required to process your purchases. This information is used solely to process relevant transactions with our payment processor and is kept completely confidential and will be used only to contact you or process transactions. If you choose to save credit card or financial information, it will be stored by PayPal or Authorize.net and should refer to their policies. You may choose to have this information removed at any time.

3. Correcting and Changing User Information and Preferences
If you are receiving e-mail communications from Basnight but wish to discontinue the service, you may request to do so at any time by filling out a request form on the Contact Us page on any of the Sites. You also have the option to request a revision of your user information at any time in the same manner.

4. Information Security
Basnight understands the need for user privacy, and we maintain strict security procedures to protect your information. Basnight has appointed an Administrator to monitor privacy practices.
Access to your data is strictly limited to specific individuals who have been trained to respect user privacy. The access given to these employees is confined to their need for such information for business reasons. A log of those who accessed the data is maintained and monitored to prevent security breaches.

5. What other information should I know about my privacy?
Basnight contains links to other web sites. Note: When you click on one of these links, you are entering another web site for which Basnight has no responsibility. We encourage you to read the privacy statements of all such sites, as their policies may be materially different from Basnight’s policies. You are solely responsible for maintaining the secrecy of your passwords and account information. Please be very careful with this information, especially whenever you are online.
In addition to the circumstances described above, Basnight may disclose member information if required to do so by law, court order, as requested by other government or law enforcement authority, or in the good faith belief that disclosure is otherwise necessary or advisable including, without limitation, to protect the rights or properties of Basnight or if we have reason to believe that disclosing the information is necessary to identify, contact or bring legal action against someone who may be interfering with our rights or properties, intentionally or otherwise, or when anyone else could be harmed by such activities.

6. What safeguards are in place to protect the loss, alteration, or misuse of my information?
All Billing & Transaction information you provide to Basnight is transmitted using SSL (Secure Socket Layer) encryption. SSL is a proven coding system that lets your browser automatically encrypt, or scramble, data before you send it to us.

7. Children and Privacy
Basnight encourages parents and guardians to be fully familiar with the sites visited by their children. Basnight sites will not intentionally contain content that is generally considered unsuitable for children.

8. Links to Other Sites
Basnight web sites may contain links to sites owned and/or operated by other organizations, and the privacy policies of those sites may differ from that of Basnight. These sites may collect data and make use of it in ways that Basnight does not. We encourage you to review the privacy policies posted on all third-party sites.

9. Transfer of Information
In accessing Basnight Sites, you may be transferring personal data that is used by Basnight for statistical, administrative, or marketing purposes. As a worldwide organization, Basnight collects data that may be transferred internationally throughout Basnight offices worldwide. In using any Basnight Site you consent to having your information transferred to and processed in the United States or any other country in which Basnight is located or conducts business. If Basnight seeks to collect any additional personal data, you will be informed of the proposed uses of that data and asked for your consent.

10. Policy Updates
This Privacy Policy represents Basnight’s promise to its web site users. Additional information that is particular to specific Basnight Sites may exist, and updates to this policy may be posted. Therefore, we suggest that users who have specific concerns about the information being gathered and the use of that information regularly view the Privacy Policy on each site. Basnight reserves the right to change the policy on its use of information collected at any time.

Online Orders:

Purchaser represents that it has provided Basnight with the correct dimensions and quantities of products required, as well as any other relevant design requirements, special punch-out patterns, and/or material specifications. Purchaser confirms there are no mistakes on this order. Once orders are authorized, the items on this order become non-cancellable and non-returnable at Basnight’s discretion, with the exception of Basnight standard inventoried parts. Any non-standard item produced prior to a customer-initiated change will be shipped and if not already paid for will be billed (F.O.B. Basnight) to customer.

In the event of obvious errors on the Basnight Website/Online Store or made in connection with Purchaser’s order, Basnight reserves the right to correct the error and charge you the correct price. In this situation, you will be contacted by Basnight and offered the option of purchasing the product at the correct price or canceling Purchasers order. Credits or refunds will be made using the same method of payment. Asterisk (*) denotes special parts or custom length members. A signed product drawing will be required for all special parts but not custom length members. These items may not be returned for credit.

Shipments made within North Carolina may be charged state sales tax unless you are a qualified reseller. It is the responsibility of the Purchaser to ensure they are paying appropriate sales tax.

Purchaser agrees to pay all invoices according to the payment method selected:

  • Credit Card/PayPal/ACH: Upon submission of the order, Purchaser authorizes Basnight to charge Purchasers credit card or account immediately in the amount due. Purchaser shall be responsible for all fees related to insufficient funds, chargebacks, etc.
  • Basnight Account: If Basnight has approved Purchaser for a Basnight Account, Basnight’s standard terms of net thirty (30) days from date of shipment, and agrees to pay interest on any past due amount at a rate of one and one-half percent (1.5%) per month or the maximum amount allowed under applicable law if less, calculated from the date such amount was due until payment is made. Purchaser agrees that any products to be shipped to a location outside of the United States will be secured with a letter of credit from an approved financial institution by the purchaser, project owner or other accepted party prior to shipment. Purchaser further agrees and promises to pay all reasonable costs of collection related to any past due amounts, including but not limited to agency and/or attorneys’ fees.
  • Promotional Coupon Codes (Promo Codes): Promotions using coupon codes cannot be combined with any other offer. Payment on orders made with a promotional coupon code are due Net 30. Products will be shipped as inventory levels permit.

Freight:

All orders will incur shipping and handling charges.

Product will be shipped to the address requested on customer purchase order.  All shipments are made pursuant to a shipment contract with an independent carrier not affiliated with, or controlled by, BASNIGHT.  Therefore, BASNIGHT is not accountable for the delivery service.  However, our customer commitment includes assistance in filing any carrier claims for damaged or lost shipment.  Claims must be initiated within 5 days of delivery (or expected delivery in the case of lost shipment)

BASNIGHT in no event shall be liable to you for any damages, whether direct, indirect, incidental, consequential, special or otherwise, because of any failure to fill orders, delays in shipment or delivery, or any error in the filling of orders regardless of the cause, therefore.

Length Restrictions: Finished hardware or Hollow Metal Frames and Doors, Wood Doors in excess of 6’ or 72” are subject to additional freight charges. Please contact Basnight’s for questions related to product up-charges. Each of the following conditions is subject to an up-charge:

  • Orders placed for product that require special shipping and handling instructions
  • Special markings or identifying tags on pallets
  • Item in excess of 6 feet ‘or 72 inches “

Price Escalators:

At Basnight’s we remain committed to providing our Customers with Innovative high-quality products. The same level of effort is employed to improve efficiencies and reduce costs throughout our operations. We have made a concerted effort to absorb increased costs thus far. However, we will be unable to continue to offset the extraordinary increase in raw materials, tariff and transportation costs that are expected to continue in 2019.

Basnight recommends that Contractors allow for inflation, supply and demand spikes and other price disrupting events.

Product Use:

Products on this site are designed and manufactured for the specific purposes shown and should not be used in other applications unless approved by a qualified design professional. All modifications to products or changes in installation procedures should be made by a qualified design professional. The performance of such modified products or altered installation procedures is the sole responsibility of the design professional or installation contractor. The installation contractor and/or qualified design professional are responsible for installing all products in accordance with relevant specifications and building codes.
Customers modifying products or installation procedures, or designing non-standard products for fabrication by Basnight shall, regardless of specific instructions to the user, indemnify, defend, and hold Basnight harmless for any and all claimed loss or damage occasioned in whole or in part by non-standard or modified products or installation procedures.
Current product catalogs on Basnight’s website are for the described specific applications of properly installed products. Basnight may correct any clerical or typographical errors. All sales are subject to Basnight’s standard terms and conditions of sale.

Product Warranty:

Basnight warrants its products to be free from defects in material or workmanship at the time of shipment.  This warranty excludes uses not in compliance with specific applications and installation procedures set forth by product manufacturers. Warranty claims must be made by Purchaser in writing within ninety (90) days of receipt of the Products.

All warranty obligations of Basnight shall be limited, at the sole discretion of Basnight, to repair or replace the defective product(s). These remedies shall constitute Basnight’s sole obligation and sole remedy of purchaser under this warranty. In no event will Basnight be responsible for incidental, consequential, indirect, exemplary, incidental, special, consequential, or punitive damages, or other losses or damages however caused, including, but not limited to, installation costs, lost revenue or lost profits. Basnight’s liability for damages shall in no event exceed the applicable portion of the purchase price for defective product(s).

Products are warranted solely by the manufacturer with the complete warranty included with the product and is also subject to the conditions set forth by the manufacturer. Product defects that arise from acts of God, accidents, misuse, misapplication, improper installation, storage damage, negligence, or modification to product(s) or its components are specifically excluded from this warranty. Product defects that arise from Purchaser providing incorrect information to Basnight, including but not limited to incorrect specifications such as incorrect dimensions, designs and/or loads, are also specifically excluded from this warranty. Basnight does not authorize any person or party to assume or create for it any other obligation or liability in connection with Products except as set forth herein.

This Warranty is expressly in lieu of all other warranties, expressed or implied, including any warranties of merchantability or fitness for a particular purpose, all such other warranties being hereby expressly excluded.

Returns:

Basnight’s accepts returns on its standard stock products under most circumstances. Customers must have an RGA (Return Goods Authorization) number before the return of material or request for credit.  To request an RGA number, email: general@basnights.com or call 1-919-942-3158.  Any material received without an RGA will not be accepted and returned at customer’s expense.

All products must be in original boxes and have full count of pieces; open boxes or containers cannot be returned. Modified or custom-made products including all products that have been specifically cut, welded or assembled may not be returned for any reason other than warranty claims made in advance by Basnight.
All customer requests to return “stock” material will have a standard 35% restocking fee in addition to original freight charges (if applicable) and will be credited after inspection (excluding return shipping and handling charges).

Returns on all factory ordered material are subject to the factory’s approval and have a minimum 45% restocking fee.

No returns of factory-ordered material under $250.00 will be accepted.  No returns on any Special-Order items or on expedited orders (i.e. Next day air, Second day air, Three-day air). All Allegion Brands (Falcon, Glynn-Johnson, Ives, LCN, Schlage, Schlage Electronics, and Von Duprin) factory ordered material is nonreturnable.
Please ship your parcel Freight, Prepaid using a Ground Service “Insured”.  COD or freight-collect shipments not accepted.

Replacement of defective material or material shipped in error will be invoiced and credited upon receipt of defective or incorrect material.  Products are warranted solely by the manufacturer.  The complete warranty is included with the product and is subject to the conditions set forth by the manufacturer.

Please note that an RGA number does not guarantee final disposition and all returns are subject to inspection.  RGA’s must be issued within 30 days from the invoice date and are valid for 45 days after issued.  All exchanged or returned merchandise must be in original factory carton, including all packaging materials, inserts, manuals, and all accessories.

US Export Control:

The commodities, technology, and/or products must be exported from the United States in accordance with the Export Administration Regulations. Diversion contrary to U.S. law is strictly prohibited.
